Florida moves to dismiss publisher lawsuit over book bans

Attorneys for the state of Florida have asked a federal judge to toss a closely watched book banning lawsuit filed by six major publishers, the Authors Guild, students, parents, and several bestselling authors. In a 25-page brief, filed on November 15, the state argues that the plaintiffs lack standing to bring the suit, which challenges two provisions of the state's newly enacted state law, HB 1069. Critics say that the law is fueling a surge in unconstitutional book bans in school libraries.

PEN America has released its most recent report documenting public school book bans for the full 2023-2024 school year, finding 10,046 bans nationwide—a more than 200% rise over the previous school year. The report, Banned in the USA: Beyond the Shelves, confirms and details the organization’s preliminary findings, released in September, with the group’s finalized stats indicating that 4,231 unique titles were banned during the 2023-2024 school year, impacting 2,662 authors, 195 illustrators, and 31 translators.

It instituted book bans and curriculum rewrites — the sort of politics pushed nationwide by Moms for Liberty, the conservative advocacy group allied with Donald J. Trump. But in this closely divided community, the board’s moves created a backlash.

A slate of Democrats swept school board elections. They promised to put “Pennridge over politics” and end an era of drama and division for this community.

PEN America finds new state laws are supercharging school book bans

In a report released today, PEN America officials said that the organization has counted more than 10,000 cases of book censorship in public schools during the 2023-2024 school year, nearly triple the number from the previous school year, when PEN America recorded 3,362 bans nationwide. PEN officials said that new state-level rules and legislation are the key drivers of the bans, with nearly 8,000 book bans recorded in Florida and Iowa, where two sweeping new laws have broadly targeted books that contain any sexual content.

Florida school district must return LGBTQ books to libraries after settlement
